ponder.ing ("we", "us", or "our") provides a web-based application that enables users to upload and analyze files using artificial intelligence technologies. These Terms of Service (the "Terms") govern your access to and use of our services ("Services"). By using ponder.ing, you agree to be bound by these Terms and our Privacy Policy.
By creating an account, uploading files, or using any part of the Services, you acknowledge that you have read, understood, and agree to these Terms. If you do not agree to the Terms, do not use the Services.
We may update these Terms from time to time. If we make material changes, we will update the "Last Updated" date at the top and may provide additional notice. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
You must be at least 13 years old to use the Services. By using ponder.ing, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms.
Some features of the Services require an account. You agree to provide accurate, current, and complete information and to keep your credentials secure. You are responsible for all activities that occur under your account.
Users may upload files (e.g., documents, PDFs, audio, video, images) for AI-powered analysis. By doing so, you authorize us to process these files using third-party AI services such as:

ponder.ing offers paid subscription plans, including Casual, Plus and Pro memberships (collectively, "Paid Plans"), which provide enhanced features and capabilities. Specific features, usage limits, and pricing for each tier are described on our website and may be updated from time to time.
All subscription payments are processed securely through Stripe, Inc. ("Stripe"), a third-party payment processor. By subscribing to a Paid Plan, you agree to Stripe's Services Agreement and authorize us to charge your designated payment method on a recurring basis.
Paid Plans are billed on a recurring basis (monthly or annually, depending on your selection).
Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date.
Pricing for renewal periods will be at the then-current rate, which we will communicate to you in advance of any price changes.
You may cancel your subscription at any time through your account settings or by contacting us at info@ponder.ing. Cancellations take effect at the end of your current billing period, and you will retain access to Paid Plan features until that time. We do not provide refunds for partial billing periods.
Subscription fees are generally non-refundable. In exceptional circumstances, we may provide refunds at our sole discretion. Contact us at info@ponder.ing to request consideration.
If a payment fails or your account becomes past due, we may:
Suspend or downgrade your access to Paid Plan features;
Retry charging your payment method;
We reserve the right to modify subscription pricing. We will provide at least 30 days' notice of any price increases. Your continued use of the Services after a price change constitutes acceptance of the new pricing.
You are responsible for any applicable taxes, duties, or government assessments associated with your subscription, except for taxes based on our net income.

Our Privacy Policy explains how we collect, use, and protect your data. By using the Services, you agree to our data practices as outlined therein.
We may modify, suspend, or discontinue the Services or any part thereof at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Services.
We may suspend or terminate your access to the Services at our sole discretion, including for violations of these Terms or if your actions create legal risk for us.
The Services are provided "as is" and "as available" without warranties of any kind.

Your sole remedy for dissatisfaction with the Services is to stop using them.
These Terms are governed by the laws of HKSAR, without regard to conflict of laws principles. All disputes shall be resolved exclusively in the courts of HKSAR.
These Terms and our Privacy Policy constitute the entire agreement between you and ponder.ing regarding the Services. If any part of these Terms is found invalid, the rest will remain in full force. Our failure to enforce any provision does not waive our right to do so later.
